MEMORANDUM OF HEARING AND ORDER for proceedings held before Judge Rebecca Grady Jennings: Continuance of Motion Hearing held on 8/19/2026. As a result of this continued failure to comply with the Court's Order for completed discovery responses, and for the reasons stated by the Court on the record, the Court finds that both Gunzburg and Coey remain in CIVIL CONTEMPT. The parties are ORDERED to jointly file a list of all subpoenas that have been issued to third parties by Thursday, 9/3/2026. Gunzburg and Coey are ORDERED to provide thorough and complete responses to the Discovery Requests, including both the interrogatories and requests for production, on or before Thursday, 9/3/2026. Plaintiffs' counsel is ORDERED to file a notice in the record as to Gunzburg's compliance by Wednesday, 9/16/2026. If the Court does not certify compliance by written order on or before Thursday 9/17/2026 at 5:00 p.m., Eli Gunzburg is ORDERED to report to the United States Marshals Service by 12:00 p.m. on 9/18/2026. Gunzburg shall remain in the custody of the Marshals Service until such time as he purges himself of contempt. If Gunzburg does not report to the United States Marshals Service as ordered, a warrant for his arrest will be issued by this Court without further notice. Gunzburg SHALL NOT transfer any assets until the Court indicates such transfers are appropriate. If written certification is not issued by the Court on Thursday, 9/17/2026 at 5:00 p.m., then this matter will be continued for a status hearing on Friday, 9/18/2026 at 12:30 p.m. before Judge Rebecca Grady Jennings in Louisville Courtroom.
