At a status conference on June 23, 2026, counsel for Plaintiff informed the court that he had resumed contact with Mr. Suarez and had provided an authorization for records signed by Mr. Suarez to Defendant's counsel.As discussed at the conference, the court denies without prejudice Defendant's Motion to Dismiss and Default of Action 32 . On or before July 8, 2026, Plaintiff will comply with the remaining discovery requests outlined by Defendant at the conference and in Defendant's prior filing. See ECF Nos. 26 , 33 . If Mr. Suarez fails to respond to these requests, the court will consider appropriate action.On or before July 22, 2026, the parties shall file a proposed, updated schedule for completing discovery and filing dispositive motions.
