ELECTRONIC ORDER: Local Civil Rule 7.2(f) requires a party to state on the first page of any brief if they used generative artificial intelligence, under the heading "Use of Generative Artificial Intelligence." This rule defines "Generative Artificial Intelligence" as any computer tool, such as ChatGPT, Claude, or Gemini, that creates text or images by learning from a large database of examples. If a party files a brief without this statement, they officially promise that they did not use generative artificial intelligence to prepare any part of that document.
Additionally, Rule 11 of the Federal Rules of Civil Procedure requires that at least one attorney--or the party, if they represent themselves--sign every motion, pleading, or other court paper. When a person signs, files, or presents a document to the court, they confirm that existing laws support their legal arguments and that real evidence backs their factual claims. Parties must check every document drafted by generative artificial intelligence for accuracy using traditional legal research methods before submitting it to the court. The person who signs the document takes full responsibility for everything in the filing, regardless of whether they used artificial intelligence to help write it. Under Federal Rule of Civil Procedure 11(c), the court may punish any violation of these standards with sanctions. These penalties may include requirements to pay the other party's legal fees, fines payable to the court, or other non-monetary punishments.
