CLERK'S JUDGMENT - Pursuant to the Court's Orders filed November 9, 2023 and September 24, 2025 and the parties settlement agreement, judgment of dismissal is entered in favor of Defendant, Mercy Care. The claims and allegations in this action that are included within the scope of the Covered Conduct as defined in the Settlement Agreement are dismissed with prejudice. Any other claims against Touchstone are dismissed without prejudice as to the United States and the case is terminated. (DXD)
Order
ORDER - The claims and allegations in this action that are included within the scope of the Covered Conduct as defined in the Settlement Agreement are dismissed with prejudice. Any other claims against Touchstone are dismissed without prejudice as to the United States. All claims that were made or could have been made in this action are dismissed with prejudice as to the Relator. The United States, the Relator, and Touchstone will each bear its own legal and other costs except as specifically set forth in the Settlement Agreement. The Court retains jurisdiction over this matter to enforce the terms of the Settlement Agreement for five years from the date of this Order. Consistent with the foregoing, the joint stipulation of dismissal of Defendant Touchstone (Doc. 154 ) is granted. As a result of all claims against Defendant Touchstone having been resolved by the foregoing, the Clerk shall enter judgment in favor of the only remaining Defendant, Mercy Care, based on the Order (Doc. 48 ).
