Before the Court is the parties' Seventh Stipulation to Extend Discovery Deadlines. ECF No. 43 . Responding to assertions made on page 4 of the stipulation, hearings are not automatically set on any motions in Federal Court and the deadline to file a reply brief is 7 days after the Response to a Motion--not 7 days before "the hearing." See LR 7-2. With respect to the parties' apparent position that they cannot proceed with discovery, including the expert disclosure deadlines, until the pending Motion to Compel (ECF No. 40 ) is resolved, the Court generally rejects this as the duty to proceed with discovery is not halted by the filing of a motion unless there is a stay.
Accordingly, IT IS HEREBY ORDERED that the Seventh Stipulation to Extend Discovery Deadlines (ECF No. 43 ) is DENIED without prejudice.
IT IS FURTHER ORDERED that the Court will address future extensions of discovery, if any, when it resolves the Motion to Compel.
