MINUTES (IN CHAMBERS): ORDER by Magistrate Judge Charles F. Eick. The Court has read and considered all papers filed in support of and in opposition to Third Party Witness Wilber Quon's "Motion to Quash Continued Deposition Subpoena, etc.," filed 9/12/11. The previously noticed 10/7/11 hearing date is vacated. The Court has taken the motion under submission without oral argument. The motion is denied on the following conditions: (1) the second deposition shall be taken at a place of Mr. Quon's choosing; (2) the second deposition shall be taken at a time convenient to Mr. Quon; (3) the second deposition shall be limited to four hours in length; and (4) HSBC shall reimburse Mr. Quon for the reasonable attorney's fees, if any, incurred by Mr. Quon during the taking of the deposition.
