ENDORSED ORDER granting 2 Motion to Seal Document 1 Complaint Exhibit C and Exhibit E at Level I. Text of Order: Plaintiff Facet Technology Corp. moves to seal (doc. no. 2) its complaint (doc. no. 1) and two attachments at Level I (doc. nos. 1-3, 1-5). Facet's motion is provisionally granted, without prejudice to any party's ability to challenge the seal or the court's ability to reconsider the seal. Because Facet's complaint largely consists of public or nonsensitive information, Facet must file on or before May 10, 2024, a proposed redacted copy of the complaint for the public docket consistent with the procedure stated in Local Rule 83.12(d). Doc. nos. 1-3 and 1-5 may be sealed at Level I in their entirety, subject to reconsideration as this matter moves forward. See Planet Fitness Int'l Franchise v. JEG-United, LLC, No. 20-cv-693-LM, 2022 WL 20053903, at *1 (D.N.H. Dec. 20, 2022) (observing that the public's presumptive right of access becomes stronger as the case moves closer to trial and explaining that confidentiality agreements between the parties do not necessarily overcome that right of access). The court notes that Doc. Nos. 1-3 and 1-5 appear to be nearly or more than 15 years old, which indicates that any sensitive information within may be stale such that the parties' interests in maintaining confidentiality may not outweigh the public's presumptive right of access.
