Minute Order ~Util - Set/Reset Motion Hearing
MINUTE ORDER (Text Only Entry) The Court's standing order provides that "[b]efore filing a motion in a case in which the parties are represented by counsel, counsel shall engage in a pre-filing meet and confer to discuss thoroughly the substance of the contemplated motion and any potential resolution.... In the notice of motion, counsel for the moving party shall certify that meet and confer efforts have been exhausted and include a summary of meet and confer efforts." (Doc. 15 .) It appears that the recently filed motion to remand (Doc. 41 ) fails to comply with this requirement, which is necessary to preserve extremely scarce judicial resources in this overburdened district. Failure to meaningfully engage in the meet and confer process may be grounds to outright deny a motion or impose sanctions. Crucially, mere disagreement on the ultimate issue does not excuse a good faith effort, as even if the ultimate issue cannot be resolved, the parties may be able to narrow the disputes. Accordingly, within seven days of the date of this order, the parties SHALL meet and confer in good faith either in person or over video conference. Within seven days of the meet and confer, movant SHALL file a declaration outlining the results of those efforts and, if appropriate, shall withdraw the motion in whole or in part. All deadlines related to the motion are continued by 14 days to accommodate this process. In addition, as the Standing Order indicates, unless the Court specifically informs the parties otherwise, civil motions set before the undersigned will be decided on the papers pursuant to Local Rule 230(g) signed by District Judge Jennifer L.
