ORDER DISMISSING CASE: IT IS HEREBY STIPULATED AND AGREED by and between the attorneys for plaintiff and defendants International Association of Sheet Metal, Air, Rail and Transportation Workers Union ("SMART"), SMART Voluntary Short Term Disability Plan Trust ("VSTD Trust"), John and Jane Doe as SMART Voluntary Short Term Disability Plan Trustees ("VSTD Trustees"), and United Transportation Union Insurance Association ("UTUIA") in the above-captioned action that all claims brought by plaintiff individually against SMART, the VSTD Trust and VSTD Trustees and UTUIA are withdrawn and dismissed with prejudice, and putative class claims are withdrawn, and SMART, the VSTD Trust, VSTD Trustees and UTUIA are dismissed as parties to this action without costs or fees for or against any party except as agreed by the parties and no attorney's fees or costs shall be requested from the Court or awarded for or against either party.
