CERTIFIED copy of order dated 02/05/2024 from the 7th Circuit regarding notice of appeal 22 ; Appellate case no. : 23-1706. In November, this court revoked Jerico Matias Cruz's leave to proceed in forma pauperis because he had failed to heed the court's instructions or indicate that he would cease his frivolous filings. See Cruz v. Illinois, No. 23-1599, 2023 WL 8251414, at *1 (7th Cir. Nov. 29, 2023). The court also ordered Cruz to immediately pay his outstanding filing fees in any pending case or appeal, and revoked his privilege of litigating new suits or appeals in forma pauperis in any court of this circuit. Id. The district court granted Cruz leave to proceed in forma pauperis in this appeal, allowing Cruz to proceed without prepayment of the filing fee. See 28 U.S.C. § 1915(a)(2). But that order but did not remove Cruz's obligation to pay the fee, see Robbins v. Switzer, 104 F.3d 895, 898 (7th Cir. 1997), and the fee remains outstanding. In light of our order in Cruz v. Illinois, we REVOKE the district court's permission to proceed in forma pauperis in this appeal. IT IS ORDERED that Cruz shall pay the appellate filing fees to the clerk of the district court within 14 days, or this appeal will be dismissed for failure to prosecute pursuant to Circuit Rule 3(b). See Newlin v. Helman, 123 F.3d 429, 434 (7th Cir. 1997). (aee, ) (Entered: 02/05/2024)
