Energy Dept. Defends Grid Info Security Rule At DC Circ.
By Morgan Conley (January 11, 2021, 4:44 PM EST) -- The U.S. Department of Energy has urged the D.C. Circuit to uphold its rule governing when the agency can withhold certain electric grid information from public records requests in the name of national security.
In a brief to the D.C. Circuit Friday, the DOE defended its new rule, which created an agency-specific framework to judge what qualifies as "critical electric infrastructure information" that would be exempt from Freedom of Information Act requests.
The agency told the court that the group challenging the rule, the Union of Concerned Scientists, can't point to any information it would have access to if it weren't...
