Title IX Enforcement In The #MeToo Era

Companies like NBC and CBS have swiftly terminated employees embroiled in these allegations, leading to controversial discussions about what employers can do to protect employees and weed out harassment before it festers. But long before the Harvey Weinstein and Matt Lauer headlines, schools across the country were grappling with a widespread student movement to address sexual assault issues, as evidenced by the 2015 documentary "The Hunting Ground," Jon Krakauer's exposé "Missoula," a Columbia University student carrying a mattress on her back at graduation, and Lady Gaga's performance with sexual assault survivors at the 2016 Oscars. In large part, the student movement was propelled by the Obama administration's far-reaching Title IX enforcement by the U.S. Department of Education's Office for Civil Rights, including the 2011 "Dear Colleague" letter (DCL) and 2014 Q&A guidance (Q&A)....
