Health Co. Must Face Pregnancy Bias Claims: 10th Circ.

Law360 (May 15, 2018, 6:54 PM EDT) -- The Tenth Circuit on Tuesday revived a discrimination suit against a health care services company by a former employee, ruling she presented enough circumstantial evidence to convince a jury that the company's explanation for terminating her employment was an excuse to fire her because she was pregnant.

The three-judge panel ruled that though Alena Fassbender didn't provide direct evidence of discrimination, the circumstantial evidence she provided could potentially persuade a jury that Correct Care Solutions LLC fired her because of her pregnancy. Comments from her supervisor...
