States, Faith Groups Tell Justices To Hear Trans Bias Case

Law360 (August 24, 2018, 5:52 PM EDT) -- A handful of religious groups and a coalition of 16 states on Thursday urged the U.S. Supreme Court to take up the question of whether Title VII blocks businesses from discriminating against transgender workers and to overturn the Sixth Circuit’s ruling that it does.

Led by Nebraska Attorney General Douglas Peterson, the states argued that the Sixth Circuit perverted Title VII’s ban on discrimination “based on … sex” in its R.G. & G.R Harris Funeral Homes decision, urging the court to grant the business’s petition for certiorari. Christian and Jewish religious groups also filed three briefs Thursday backing the funeral home...
