7th Circ. Nixes Appeal Over NLRB's Dues Refund Ruling

Law360, New York (January 2, 2013, 6:54 PM EST) -- The Seventh Circuit has dismissed an appeal by dues-paying nonmembers of unions who argued that a National Labor Relations Board ruling over dues refunds was invalid since recess appointment powers were improperly used to fill NLRB vacancies, finding they lacked standing.

The appeal centered on nonunion members — part of the various unions' bargaining units — who wished to opt out of paying dues used to support political and other activities unrelated to collective bargaining, contract administration or grievance adjustment, according to the Dec. 26 opinion...
