Game Clock Running Down, NLRB GC Turns To The Crowd
Law360, New York (February 15, 2017, 11:30 AM EST) -- After introducing a flurry of changes to the labor laws affecting private universities, the National Labor Relations Board (NLRB) is on the brink of a major shift in composition. President Donald Trump can now begin filling two vacancies on the five-member, quasi-judicial board, which would shift the majority from Democratic to Republican control. General counsel Richard F. Griffin — in many respects a quarterback for the agency — will conclude his four-year term in November of this year, and be replaced by Trump's choice to lead. For a brief while, Griffin and former President Barack Obama's board appointees remain in control of the agency, but time has run out for them to run another play. Changing labor law takes years (the general counsel puts novel cases before the board, which then sets new precedent)....
