Law360 (April 23, 2019, 4:22 PM EDT) -- South Carolina's challenge to oil- and gas-related seismic testing off the Atlantic Coast and to President Donald Trump's pro-drilling executive order should be tossed because the state misinterpreted the scope of the order, the federal government argued Monday.
South Carolina in January joined a suit challenging the National Marine Fisheries Service's authorization of air gun seismic surveys for oil and gas exploration, known as incidental harassment authorizations, because the testing could injure or disrupt whales and other marine animals. The NMFS, however, said in a motion on Monday that the state had made several unique claims that should not be allowed to proceed....
