Judge Won't Toss $100M Oil Contract Fight

By Howard Goodman (July 19, 2012, 6:45 PM EDT) -- A Pennsylvania federal judge refused Wednesday to dismiss Defense Solutions Inc.'s lawsuit claiming the misrepresentations and dithering of private equity firm Alliance Energy Fund Inc. caused the military contractor to blow a $3.6 billion oil deal with Iraq that would have brought a $106 million commission.

U.S. District Judge J. William Ditter denied a motion to dismiss filed by Leonard Moore, one of four individuals named in the suit, saying that Moore's only argument had been to dispute the facts of Defense Solutions' complaint, and at this stage of the proceedings, "a resolution of fact is not appropriate."
