Nonprofits Sue FirstEnergy Over Arsenic Discharges

Law360, New York (May 9, 2011, 7:35 PM EDT) -- The Sierra Club and two environmental groups hit FirstEnergy Corp. with a lawsuit on Monday that accuses the company of violating the Clean Water Act by dumping unlawful amounts of arsenic into tributaries of the Cheat River in West Virginia.

The lawsuit, filed in West Virginia federal court, claims that Ohio-based FirstEnergy violated monthly average or daily maximum arsenic limits set under a discharge permit at least 14 times from July to November.
