Enviros Fail To Force Review Of BNSF Rail Yard Project
By Derek Hawkins (June 29, 2011, 12:57 PM EDT) -- A federal judge in Kansas on Tuesday denied two environmental groups' request to force the U.S. Army Corps of Engineers to re-examine the environmental effects of a planned BNSF Railway Co. rail yard in Gardner, Kan.
U.S. District Judge Carlos Murguia ruled that the Corps conducted an adequate environmental assessment of the proposed 1,059-acre facility and properly weighed the information on the project submitted by BNSF.
The Natural Resources Defense Council and Hillsdale Environmental Loss Prevention filed suit against the Corps and BNSF in early 2010, claiming the agency violated the Clean Water Act and the National Environmental Policy Act by...
