DC Circ. Won't Rehear Challenge To EPA Lead Emissions Rule

Law360, New Orleans (October 4, 2013, 4:19 PM EDT) -- The D.C. Circuit on Thursday denied a rehearing request from a coalition of environmental groups claiming the appeals court’s decision to uphold federal lead emissions standards allows the U.S. Environmental Protection Agency to bypass technology requirements.

Rejecting an en banc rehearing petition from the Sierra Club, Natural Resources Defense Council and other environmental groups, the D.C. Circuit solidified its May ruling backing the EPA’s 90 percent reduction in allowable lead emissions from secondary lead-smelting facilities.
