Defining ESA's 'Distinct Population Segment' At DC Circ.

By Patrick Parenteau (August 15, 2017, 11:04 AM EDT) -- In Humane Society of the United States v. Zinke, No. 15-5041 (Aug. 1, 2017), the D.C. Circuit upheld the decision of the district court striking down the rule delisting the "Western Great Lakes Distinct Population Segment" (WGLDPS) of the gray wolf (Canis lupus) under the Endangered Species Act. This marks the fourth time that the courts have blocked attempts by the U.S. Fish and Wildlife Service to delist separate populations of wolves under the DPS policy. The decision is sure to inflame the controversy surrounding the ESA and add momentum to bills moving though both houses of Congress that would, in the view of many conservation organizations, weaken the law by transferring more authority to the states and curtailing judicial review, among other things....
