Contract: Other | New Jersey
Order
TEXT ORDER - The Court has carefully considered Defendant USA Management, LLC's ("USA") motion for an order to show cause. (ECF No. 14 ). The request is DENIED as emergent relief is not warranted based on the present record. USA's assertions regarding attempts to recoup monies beyond the Default Judgment (ECF No. 11 ) and alleged harm caused by Plaintiff Stardust Recreation Association's ("Stardust") contact with USA's clients does not show that the alleged injury is immediate and irreparable under Fed. R. Civ. P. 65, and the Court denies the motion on this basis without further review. L.Civ. P. 65.1(a). Further, USA's arguments in support of vacating the Default Judgment on jurisdictional grounds, as well as the sufficiency of Stardust's claims, demonstrate that this matter may be considered by motion practice in the normal course. So Ordered by Judge Julien Xavier Neals on 5/21/2024. (kd)
