MINUTE ORDER issued by Courtroom Deputy for Chief District Judge Troy L. Nunley on April 16, 2026: On March 27, 2026, the Court issued an order to show cause as to why Appellee should not be sanctioned for failure to timely an opening brief. (ECF No. 5 .) On April 3, 2026, Appellee filed a response, in which Appellee contends he initially determined not to participate in this appeal due to the fact that he could not afford to engage to engage counsel but now, desires to proceed pro se. (ECF No. 6 .) Having considered the response and finding good cause, the Court hereby DISCHARGES the Order to Show Cause. In addition, the Court hereby GRANTS Appellee's Substitution of Attorney, (ECF No. 7 ), leaving Appellee in pro per. Finally, the Court will accept Appellee's answering brief, attached to his response as Exhibit A, as timely filed. (ECF No. 6 -1.) The matter is hereby SUBMITTED, without oral argument.
