Order on Motion to Withdraw as Attorney
PAPERLESS ORDER. THIS CAUSE came before the Court upon Attorney Abraham Ovadia's Unopposed Motion for Guidance Regarding Withdrawal of Counsel. 56 . Attorney Ovadia previously moved to withdraw as counsel of record for Defendant Yosnely Pereda Sosa, but the Court denied his motion without prejudice and stayed the case so that Defendant Sosa could either retain new counsel or inform the Court of her intent to proceed pro se. (ECF No. 42). Now, Attorney Ovadia informs the Court that he has been unable to reach Defendant Sosa since August 4, 2026. (ECF No. 56) at 2. He now asks the Court for guidance on how to withdraw when he cannot reach his client. Id. The Court DIRECTS Attorney Ovadia to immediately provide a physical and digital copy of this Order to Defendant Sosa and promptly file a notice on the docket indicating he has done so. In providing these copies, Attorney Ovadia shall also explain the implication of this Order. The Court hereby notifies Defendant Sosa that if she does not file a notice on the docket indicating she has retained new counsel on or before October 7, 2026, the Court will presume she intends to proceed pro se. If she continues to fail to participate in this litigation, she will be understood to be in default. Attorney Ovadia may file another motion to withdraw on October 8, 2026. Therein, he shall provide the Court with a detailed affidavit of his attempts to reach his client, including the dates he attempted to reach her, the methods he employed, and the frequency with which he tried to reach her. Attorney Ovadia shall provide this information both for his attempts to reach his client as it pertains to providing her with this Order and also with his prior attempts to reach her since August 4, 2026. He shall also restate the reasons he seeks to withdraw his representation. Attorney Ovadia's Motion is DENIED WITHOUT PREJUDICE in as much as he seeks to withdraw at this time. Signed by Judge K.
