ORDER: In response to the court's Order (Aug. 5, 2026), ECF 51 , to show cause regarding personal jurisdiction, plaintiff concedes that personal jurisdiction is lacking and thus consents to a dismissal. Resp. 12, ECF 52 . Plaintiff asks that the that court "[d]ismiss this action under Fed. R. Civ. P. 12(h) (3), with the order and judgment stating that the dismissal is involuntary, is without prejudice, is based on lack of subject matter jurisdiction, and does not adjudicate the merits of any claim or defense; [d]eny Defendant Medina Lopez's Motion to Dismiss for Lack of Subject Matter Jurisdiction (ECF 39 ) as moot; and [o]rder that each party bear its own attorney fees and cost."
