ORDER by Magistrate Judge Lisa J. Cisneros: The Court has reviewed the parties' 7130 Joint Letter regarding a deposition of Sarfraz Maredia for the QLF001 bellwether case. The topics that Plaintiffs wish to explore here relate to Maredia's work for Uber in Texas regarding background checks in that state. That issue may be highly relevant in this bellwether case where Plaintiff asserts that Uber failed to identify disqualifying information about the driver who allegedly sexually assaulted her, which Plaintiff contends would have been captured by more thorough background checks.
Uber notes that in resolving a previous dispute regarding MDL-wide corporate discovery, the Court afforded Plaintiffs a limited amount of time to depose Maredia and certain other so-called "apex" witnesses, Dkt. No. 2600 at 6-7, and Plaintiffs chose to apply that time to other witnesses instead. Maredia's work in Texas at issue here differs from his later work in a national role that supported Plaintiffs' previous request to depose him in that earlier context. See Dkt. No. 2518-3 (under seal). That work in Texas is sufficiently relevant to this case arising from an alleged assault in Texas, and sufficiently distinct from the subject matter the Court addressed previously, to warrant discovery notwithstanding that previous Order. Uber's request for a protective order barring this deposition is therefore DENIED. (Having found the deposition warranted, the Court declines to cabin the subject matter of Plaintiff's examination.)
Sufficient cause having been shown, the related 7129 Administrative Motion to File Under Seal is GRANTED with respect to third-party names, but otherwise DENIED. Uber has not shown good cause to seal these documents based on any likely practical harm from public disclosure of its internal discussions around ten years ago regarding now-defunct local regulations. Uber shall file documents in the public record consistent with this Order no later than September 7, 2026.
