The Court accepts both QLW Law Group and Defendants' counsel's responses to the Order to Show Cause [20 - 23] and does not impose any sanction on either for the failure to appear at the conference. However, the Court emphasizes to the parties that it is important for counsel to personally review all Court orders, ensure their calendars are accurate, and not rely on staff to communicate their contents. All orders will continue to be served promptly via ECF. As Mr. Finerman points out, Plaintiff has been granted leave to move for sanctions, and the Court may issue orders in response to Plaintiff's forthcoming motion for sanctions, including a deadline for Mr. Finerman and QLW Law Group to oppose that motion, so the Court advises Mr. Finerman to continue to monitor his e-mail for relevant orders in this case. ORDER granting 47 Letter Motion for Leave to File Document. The Court grants the motion insofar as it accepts the Clerks Certificate of Default nunc pro tunc. But the Court will not order Defendant/Third-Party Plaintiff to move for default judgment until the conclusion of the underlying action. See Rimini v. J.P. Morgan Chase & Co., No. 22 Civ. 7768 (JPC), 2023 WL 4847243, at *2 (S.D.N.Y. July 28, 2023) ([I]n the interests of avoiding inconsistent judgments, the Court generally does not consider default proceedings against non-appearing defendants until it has resolved the liability of those defendants who have appeared.); Dkt. 32 at 2 (acknowledging that "the third party action is related to the underlying first party action and arises out of the same transaction and occurrence").
