Scheduling Order
SCHEDULING ORDER: On July 1, 2026, Defendants filed a letter providing the Court with an update on the status of discovery. Defendants represent that they have served their initial disclosures yet Plaintiffs have not served their initial disclosures or any discovery requests. The Court thanks Defendants for the update. The Court now directs Plaintiffs for a second time to meet their discovery obligations and comply with the discovery schedule set in the above-entitled action. Plaintiffs are warned that a repeated failure to comply with discovery obligations may result in sanctions including dismissal for failure to prosecute. See Davidson v. Dean, 204 F.R.D. 251, 257 (S.D.N.Y. 2001) (finding dismissal with prejudice under Federal Rule of Civil Procedure Rule 37(b)(2) warranted where the plaintiff had actual knowledge that the potential consequences of disobeying a discovery order included dismissal of his claims.); Mahon v. Texaco Inc., 122 Fed.Appx. 537, 539 (2d Cir. 2005) (affirming dismissal under Rule 37(b)(2)(C) as a discovery sanction, holding it was not an abuse of discretion where the district court routinely explored less drastic alternatives to dismissal to secure plaintiff's compliance with its discovery orders and repeatedly warned plaintiff that her continued failure to comply with court's orders could result in dismissal. The parties are directed to file a joint status letter on July 31, 2026, informing the Court as to the status of discovery. A case management conference in this matter is scheduled for Monday, September 14, 2026 at 10:00 a.m. in Courtroom 17-D, United States Courthouse, 500 Pearl Street, New York, New York.
