Order Dismissing Case
TEXT ORDER: On February 21, 2023, the Court approved a settlement agreement between Plaintiff and the remaining Defendants. See Dkt. No. 45 . In the stipulation, Plaintiff "agree[d] that she [would] execute and file, with the Court, such documents as shall be necessary to cause the above-styled action to be dismissed with prejudice from the docket of the Court." Id. 11. Plaintiff has not yet filed a motion for voluntary dismissal with prejudice pursuant to Federal Rule of Civil Procedure 41(b). See Docket. However, Local Rule 68.1(b) provides that: "If the... documents [required to terminate an action by reason of settlement] are not filed within... thirty (30) day[s of the notification of settlement to the Court], the Clerk shall place the action on the dismissal calendar." L.R. 68.1(b). Accordingly, the Court DISMISSES this action with prejudice, and instructs the Clerk of the Court to close this action. SO ORDERED by Senior Judge Lawrence E. Kahn on 4/25/2023. (dpk)
