Reconsideration
ORDER GRANTING PROGRESSIVE CASUALTY INSURANCE COMPANY'S MOTION FOR RECONSIDERATION by Judge Cynthia Valenzuela: Defendant Progressive Casualty Insurance Company's ("Progressive") Motion for Reconsideration 91 is GRANTED. The Court MODIFIES its 11/7/2025 MSJ Order 90 solely to the extent that it denied Progressive summary judgment on Plaintiff's Fifth Cause of Faction for Breach of Contract. Progressive's Motion for Summary Judgement 56 is GRANTED as to that claim. All other rulings in the 11/7/2025 Order remain unchanged. Because this Order resolves the sole remaining claim in this action, a separate final judgment will issue. (gk)
