Order Setting Hearing on Motion
PAPERLESS ORDER SETTING BRIEFING SCHEDULE, HEARING AND JOINT NOTICE DEADLINE: This matter is before the Court upon Defendants' Motion for Leave to Take the Continued Deposition of Plaintiff Robin Fleming [DE 285], Defendant's Amended Motion to Compel Discovery [DE 288], Defendant's Motion for Order Compelling a Mental Examination of Plaintiff Robin Fleming [DE 314]. The Court shall conduct an in-person hearing on the Motions [DEs 285, 288, 314] on July 24, 2026, at 1:30 p.m. in the West Palm Beach Division before Chief Magistrate Judge William Matthewman. The hearing shall be held in the West Palm Beach Federal Courthouse, Courtroom 6, Third Floor. The hearing shall not be rescheduled absent the most compelling and extraordinary circumstances supported by sworn declaration or affidavit. In advance of the scheduled hearing, the Court directs the parties' counsel to confer, either in person or by telephone, in good faith and for as long as necessary to address the pending discovery disputes in an effort to resolve them. Thereafter, counsel for the parties shall file, on or before July 22, 2026, a Joint Notice advising whether the discovery disputes have been resolved, and if not, what specific issues remain for determination by the Court and a brief recitation of the position of the parties on each specific issue. The Court shall consider sanctions or cost-shifting against any party or counsel who fails to comply with all discovery obligations, fails to comply with applicable rules and orders, or who takes a frivolous, dilatory, or unreasonable discovery position.
