Minute Order Order on Stipulation
MINUTE ORDER IN CHAMBERS of the Honorable Magistrate Judge Elayna J. Youchah on 7/1/2026.
Pending before the Court is the fifth stipulation seeking to extend discovery (ECF No. 88 ). First, the parties must review, and in the future comply with, LR IA 6-2 which establishes the form of the Court's Order when attendant to a stipulation or unopposed motion. Future failure to comply with this Local Rule will result in the Court denying the parties' submissions.
Second, the Court is sympathetic to the situation that is prompting this fifth request to extend; however, if the parties determine by July 20, 2026, that the individual designated to be the 30(b)(6) is unavailable to appear for deposition, then a substitute 30(b)(6) designee must be identified and prepared to appear no later than the close of the fifth extended discovery period. No further extensions of discovery will be granted.
Accordingly, IT IS HEREBY ORDERED that the fifth Stipulation to Extend Discovery (ECF No. 88 ) is GRANTED.
IT IS FURTHER ORDERED that if the individual designated to appear as the 30(b)(6) witness is found to be unavailable for deposition, which determination must be made by July 20, 2026, then the producing party must designated a substitute witness to appear no later than the close of discovery, which is extended to August 7, 2026.
IT IS FURTHER ORDERED that the dispositive motion deadline is extended to October 8, 2026.
IT IS FURTHER ORDERED that no further extensions of discovery will be granted.
