Order on Motion for Writ of Mandamus
ORDER. Plaintiff moved the court for a writ of mandamus, requesting the court command the Secretary of the Navy at such time, Carlos Del Toro, and the Naval Discharge Review Board ("NDRB") "provid[e] Plaintiff the required decision from [the] 'Post Board Review.'" ECF No. 223, p. 3. Defendant avers that shortly after Plaintiff's motion, "the Naval Discharge Review Board issued a decision for [Plaintiff]," making Plaintiff's request moot. ECF No. 225, p. 1. As proof, Defendant appended a copy of the NDRB's letter to his response. ECF No. 225-1. Because the NDRB mailed Plaintiff the Post Board Review form, id., the court denies Plaintiff's writ of mandamus as moot. It is so ordered. Signed by Judge Omar A. Williams on 1/26/2026. (Matier, K)
