The Court has reviewed Defendant Anschutz Exploration Corp.'s ("AEC") Motion to Bifurcate Trial, AEC's supporting brief, Plaintiffs' notice of non-opposition, and Defendant Industrial Welding & Supply Co.'s ("IWS") response in opposition to the motion. The Court observes that IWS's opposition raises novel arguments opposing bifurcation of Plaintiffs' claims into two separate trials that are left unaddressed in AEC's initial motion. As such, the Court ORDERS that Defendant AEC (and Plaintiffs Simpkins and Vollmar) may submit a Reply addressing IWS's response no later than September 18, 2026, if they so choose.(Court Staff, ssw)
