ORDER denying 78 Motion to Reopen Case for the reasons stated in Defendant's Opposition, Docket No. 79 . However, to ensure Plaintiff's rights are protected, the Court shall reissue the Opinion and Order granting Defendant's Motion for Summary Judgment and the Judgment. Plaintiff shall have 30 days from the entry of these orders to file an appeal. The taxation of costs shall be deferred pending any appeal.
