Order Transferring to Another District
ELECTRONIC Order Transferring Case.
Before the Court is Defendant Anoison Electronics, LLC's ("Anoison Electronics") Motion to Transfer (the "Motion") (Doc. No. 13). Anoison Electronics requests that the Court transfer this case to the United States District Court for the Western District of Texas, Austin Division, because a first-filed related case is pending there and thus, under the "first-to-file" rule, this Court should transfer this case to the Western District of Texas. Doc. No. 13 at 3. After Anoison Electronics, LLC filed the present Motion, it filed a Supplemental Certificate of Conference (Doc. No. 19) indicating that Plaintiff Anoison Japan Co., Ltd. is unopposed to the relief requested in the Motion. See Doc. No. 19 at 1 (emphasis added). The Court has carefully considered the Motion, the supporting appendix, and the applicable law, including the issues raised in the related case. For the following reasons, the Court GRANTS the Motion and TRANSFERS this case to the Western District of Texas, Austin Division.
Prior to the filing of this case, a related case involving Defendant Anoison Electronics was removed to the Western District of Texas, Austin Division. See Anoison Electronics, LLC v. Quan, et al., Civ. Action No. 1:26-CV-01826, at Doc. No. 1 (notice of removal). "Under the first-to-file rule, when related cases are pending before two federal courts, the court in which the case was last filed may refuse to hear it if the issues raised by the cases substantially overlap." Cadle Co. v. Whataburger of Alice, Inc., 174 F.3d 599, 603 (5th Cir. 1999). The Court finds that the issues raised in this case and the first-filed related case in the Western District of Texas "substantially overlap" such that the issues are more appropriately heard in the Western District of Texas. Id. Accordingly, the Court GRANTS Defendant Anoison Electronic's Motion and hereby TRANSFERS this case to the Western District of Texas, Austin Division, where the first-filed case is pending (Anoison Electronics, LLC v. Quan, et al., Civ. Action No. 1:26-CV-01826).
