MINUTE ENTRY for proceedings held before Judge John J Tuchi: Discovery Dispute Hearing held on 7/7/2026. Discussion held. IT IS ORDERED: 1) vacating the remaining case management schedule and deadlines to be reinstated later as set forth below; 2) on or before July 17, 2026, the parties shall meet and confer on all of Defendants' assertions of missing, incomplete, inadequate and rule/order deficient disclosures pursuant to FRCP 26(a)(1) and responses to Defendants' written discovery requests to date; 3) on or before August 17, 2026, Plaintiff shall serve complete and corrected Rule 26(a)(1) disclosures as well as responses to all of Defendants' requests for written discovery, which shall comply with all Federal Rules of Civil Procedure, Local Rules of Practice for the District of Arizona, General Orders for the District of Arizona, and standing and other orders and directives of this Court; 4) by that same delivery date, the parties shall also have met and conferred and submitted to the Court another joint proposed case management schedule for all remaining vacated milestones, adding no more than 6 weeks to the fact discovery stage milestones still outstanding to facilitate the above delineated "re-do" for Plaintiff's deliverables, and then carrying that up-to-6-week extension through the remaining phases of case management, to include expert disclosure and discovery and motion practice; 5) any additional discovery disputes not yet formally noticed to the Court shall be initiated by the Court's previously noted preferred procedure, with meet and confers on any separate issues delayed until at least 17 days from the date of this hearing to allow the parties to focus on identifying and remedying the significant deficiencies on Plaintiff's part comprising the instant dispute; 6) counsel for Plaintiff shall hereafter respond to contacts from counsel for defense in this matter pertaining to discovery and related logistical issues within one business day of any such initiating inquiry. IT IS FURTHER ORDERED declining to impose discovery sanctions against Plaintiff involving preclusion of evidence or information at this juncture but leaving under advisement whether any monetary sanctions will be imposed.
