Mediation Minute Order
MEDIATION MINUTE ORDER - Today the undersigned magistrate judge conducted a settlement conference with the parties and counsel in this case and the related case (see Case No. 20-1067-KHV-GEB). A comprehensive, final settlement was not reached. But the parties made significant progress toward that objective. That is, guided by the recent judgment of the Tenth Circuit Court of Appeals remanding the issue of training-related injunctive relief (see ECF No. 634), the parties stipulated to certain discovery, specifically, interrogatories focused on certain post-remand training changes made by the Kansas Highway Patrol, along with certain post-remand data on traffic stops. These interrogatories shall be served today and answered no later than 8/7/26. Plaintiffs shall have 30 days to review and analyze those interrogatory answers and the accompanying data. While this discovery process is ongoing, the parties also have agreed to engage in a collaborative process concerning certain additional training changes that might be implemented by the Kansas Highway Patrol. Considering this significant progress, the parties and counsel do not believe there is any need, at least at this time, for the presiding U.S. District Judge, Kathryn H. Vratil, to decide the scope-of-remand issues which the parties have briefed (see ECF Nos. 653, 654, 655, & 656). Still, to ensure this litigation is timely concluded, by no later than 9/25/26, unless the parties have jointly filed a proposed permanent injunction, they shall file a joint status report outlining their views on the specific issues that remain to be decided by Judge Vratil, the proposed manner to decide those issues, and a timetable for same.
