MINUTE entry before the Honorable Daniel P. McLaughlin: Defendants' motion for sanctions 601 is granted in part and denied in part. The record reflects that -- following the Court's order granting Defendants leave to conduct Rule 35 examinations of Plaintiffs 569 -- Plaintiff Jamya B. (whom Defendants concede faces many difficult personal circumstances) missed her first scheduled examination with Defendants' expert (Dr. Wolf), then sat for an examination with Dr. Wolf for an hour and twenty minutes, and then missed a third scheduled examination. The premise of Defendants' instant motion is that Jamya's noncompliance has "prevented Defendants from completing their expert disclosures." ( 601 at 1.) However, contrary to that assertion, Dr. Wolf testified at her deposition in no uncertain terms that she "absolutely" was "able to complete a report for Jamya... given the length of time [she was] able to meet with her" and she had "enough data to be able to issue opinions." ( 616 at 3-4.) Faced with this apparent lack of prejudice, Defendants protest that Dr. Wolf's report will be "less reliable" because she did not complete her examination of Jamya. In light of that concern, and as a sanction, the Court will prohibit Plaintiffs from challenging the reliability of Dr. Wolf's anticipated report as it relates to Jamya. As an additional sanction, the Court orders Plaintiffs to compensate Dr. Wolf for her time and travel for the first meeting and her time preparing for the third meeting. The relief requested by Defendants is otherwise denied. Defendants shall now disclose Dr. Wolf's expert report regarding Jamya by 7/2/26. Plaintiffs may depose Dr. Wolf regarding her forthcoming report and the deposition shall be completed by 7/10/26. The parties are to file a joint status report by 7/13/26 confirming that this additional expert discovery has been completed. Mailed notice(maf) (Entered: 06/24/2026)
