JOINT STIPULATION OF DISMISSAL WITH PREJUDICE AND ORDER OF DISMISSAL: COME NOW, Plaintiff, LUIGI GIROTTO, and Defendants, TIBI, LLC, a Delaware limited liability company, d/b/a TIBI, and 120 WOOSTER LLC, a New York limited liability company, by and through their respective undersigned counsel, pursuant to a confidential settlement agreement and pursuant to the provisions of Rule 41(a)(1) of the Federal Rules of Civil Procedure, who do hereby stipulate to the dismissal of the above-captioned action, with prejudice, with regard to all Defendants. Each party shall bear their own attorneys' fees and costs. SO ORDERED. 120 Wooster LLC (a New York limited liability company ) and Tibi, LLC (a Delaware limited liability company) terminated. ORDER: The Court has been informed by the parties that all claims asserted herein have been settled in principle. See ECF No. 22. Accordingly, the above-entitled action is hereby dismissed and discontinued without costs, and without prejudice to the right to reopen the action within thirty days of the date of this Order if the settlement is not consummated. Any application to reopen must be filed within thirty days of this Order; any application to reopen filed thereafter may be denied sole ly on that basis. Further, if the parties wish for the Court to retain jurisdiction for the purposes of enforcing any settlement agreement, they must submit the settlement agreement to the Court within the same thirty-day period to be so-ordered b y the Court. Per Rule IV(C) of the Court's Individual Practices in Civil Cases, the Court will not retain jurisdiction to enforce a settlement agreement unless it is made part of the public record.
