Order on Motion for Protective Order
PAPERLESS ORDER. THIS CAUSE came before the Court upon Plaintiff's Motion for Protective Order. 12 . Therein, Plaintiff requests that the Court enter "an appropriate protective order" or provide "further and additional relief as the Court determines legal and just" in response to Defendant's filing of medical records containing Plaintiff's full date of birth. Id. Rule 5.2 of the Federal Rules of Civil Procedure governs court filings containing sensitive personal information, including full dates of birth. Generally, parties are required to either (1) redact such personal information from any document prior to its filing, or (2) file such document under seal without redaction. Fed. R Civ. P. 5.2(a), (d). Here, Defendant filed Plaintiff's medical records [7-2] in support of its Renewed Notice of Petition for Removal of Action to Federal Court 7 . Several pages of Plaintiff's medical records contain Plaintiff's full, unredacted date of birth. [7-2] at 515. Accordingly, upon consideration of the Motion, the pertinent portions of the record, and being otherwise fully advised in the premises, it is ORDERED AND ADJUDGED that the Motion for Protective Order 12 is GRANTED. Docket entry [7-2] is STRICKEN. The Clerk of the Court is directed to STRIKE docket entry [7-2]. It is further ordered that Defendant shall re-file Plaintiff's medical records in support of Defendant's Renewed Notice of Petition for Removal of Action to Federal Court 7 , with Plaintiff's personal information redacted in accordance with Rule 5.2 of the Federal Rules of Civil Procedure, on or before July 6, 2020.
