Order on Motion to Intervene
ORDER. Arlene Acosta, Plaintiff's wife, represents that she has "lost consortium and services of her husband," see ECF No. 36-1, because he allegedly "suffered extensive injuries in the course of his employment due to the negligence of Defendant Home Depot," see ECF No. 35. Accordingly, she moves to intervene in this action under Rule 24 of the Federal Rules of Civil Procedure, see ECF No. 36, which provides that "the court must permit anyone to intervene who...claims an interest to the property...that is subject to the action, and is so situated that disposing of the action may...impair or impede the movant's ability to protect its interest," see Fed. R. Civ. P. 24(a)(2). No other party has opposed Mrs. Acosta's 36 Motion to Intervene. Because the court is satisfied, based on her representations, that Mrs. Acosta may intervene without destroying its diversity-based jurisdiction over this action, it hereby GRANTS the unopposed Motion to Intervene. See ECF No. 35 (describing the granting of such motions as "a routine procedural move") (internal citation and quotation marks omitted). Separately, the court notes that Plaintiff and Mrs. Acosta move the court for leave to amend the Complaint by, inter alia, adding "RXO Last Mile, Inc." as a party to this action. ECF No. 48, at 1 (explaining why adding such party is "necessary" based on "Home Depot's June 22, 2026, discovery responses"). Any objections to their 48 Motion to Amend shall be filed on or before July 10, 2026, and any replies shall be filed on or before July 17, 2026. It is so ordered. Signed by Judge Omar A.
