Order Affirming Bankruptcy Court
ORDER AFFIRMING BANKRUPTCY COURT'S JUDGMENT - Years of litigation in California culminated in a nearly $1.7 million award of punitive damages, costs, and attorney's fees in favor of The Retirement Group, LLC and against Ardent Retirement Planning, LLC and its head, Steven Dalton. Dalton filed a Chapter 7 bankruptcy petition in the United States Bankruptcy Court for the Southern District of Indiana. The Retirement Group filed a complaint against Dalton to determine whether the debt he owes them is a debt for willful and malicious injury and therefore nondischargeable under the Bankruptcy Code. The Bankruptcy Court determined that Dalton was precluded from litigating that issue because it had been litigated and decided in the California proceedings and, consequently, entered summary judgment in The Retirement Group's favor.
