Order on Motion for Extension of Time
PAPERLESS ORDER on Motion for Extension of Time. THIS CAUSE is before the Court on Plaintiff's Motion for Extension of Time to Comply with Certain Discovery Deadlines (the "Motion for Extension of Time"), ECF No. 217 . In the Motion, Plaintiff requests an extension of time "through July 22, 2026" to comply with the Order After Discovery Hearing (the "Discovery Hearing Order"), ECF No. 208 , where the undersigned ordered Plaintiff to, inter alia, produce (1) amended Rule 26(a)(1) initial disclosures and corresponding documents; and (2) updated responses to Defendants' First Requests for Admission Nos. 25 and 47-53 by July 8, 2026. See ECF Nos. 217 at 1-2 and 208 at 5. Plaintiff requests this extension of time because on July 2, 2026, his legal team was set for an evidentiary hearing in another matter on July 14, 2026, outside the District; "must devote its attention to preparing for this evidentiary hearing;" and will be traveling for the hearing. See ECF No. 217 at 1. Plaintiff also states that he intends to "finalize the discovery at issue and make the requisite production as soon as it is able after the evidentiary hearing has concluded" and that he "believes in good faith that [he] has demonstrated good cause for the extension requested." See id. at 3. While Plaintiff indicates in the Motion that Defendants oppose the requested extension, in Defendants' Response to Plaintiff's Motion for Extension of Time to Comply with Discovery Obligations (the "Response"), ECF No. 223 , Defendants note that the Parties conferred again after Plaintiff filed the Motion and Defendants indicate in the Response that "if the Court is inclined to grant an extension of the July 8, 2026 deadline until July 22, 2026, Defendants have no objection." See ECF No. 223 at 3. As such, the Court finds good cause for the extension of time.Further, Plaintiff requested that the Court reschedule the Discovery Status Conference currently set for July 13, 2026, at 11:30 a.m., see ECF No. 194 , via email correspondence to chambers, with all Parties copied. In the Response, Defendants indicated that they do not object to rescheduling the Discovery Status Conference, if the Court agrees. See ECF No. 223 at 3. The Court agrees and will reset the Discovery Status Conference by separate order but will require Plaintiff to submit the discovery that is the subject of the Motion before the rescheduled Discovery Status Conference date. Accordingly, the Motion, ECF No. 217 is GRANTED in part and DENIED in part. Plaintiff SHALL produce (1) amended Rule 26(a)(1) initial disclosures and corresponding documents; and (2) updated responses to Defendants' First Requests for Admission Nos. 25 and 47-53 by no later than July 15, 2026. Signed by Magistrate Judge Marty Fulgueira Elfenbein on 7/8/2026. (hjd)
