MINUTE ORDER IN CHAMBERS of the Honorable Magistrate Judge Elayna J. Youchah on 8/19/2026.
Before the Court is the Motion to Extend Time to File Reply in Support of Motion to Substitute Real Party in Interest. ECF No. 485 . The Court has no objection to the short extension requested. What the Court questions is why Interested Party Dixie Switzer did not contact opposing parties to discuss and attempt to obtain agreement to the short extension before filing her Motion. Short extensions of time are a common courtesy granted in civil litigation. With the overall goal of Rule 1 of the Federal Rules of Civil Procedure in mind, the Court denies the Motion to Extend Time without prejudice to provide Interested Party Dixie Switzer an opportunity to obtain agreement and present a stipulation to the Court.
Accordingly, IT IS HEREBY ORDERED that the Motion to Extend Time to File Reply in Support of Motion to Substitute Real Party in Interest (ECF No. 485 ) is DENIED without prejudice.
IT IS FURTHER ORDERED that all parties (including the Interested Party) are to promptly communicate regarding Ms. Switzer's short extension request and, if agreement is reached, present a stipulation to the Court reflecting the same. If no agreement is reached, Ms. Switzer may refile her existing motion simply adding that efforts to reach agreement were not successful.
