TEXT ORDER : The Court is in receipt of Defendant's letter requesting that the Court reinstate Defendant's Motion for Summary Judgment and the parties' associated briefing. (D.E. No. 54 ). To the extent necessary, the parties shall update their submissions as necessary to account for any developments in the case law. The parties shall then serve and re-file their submissions in accordance with Old Appendix N. Accordingly, Defendant shall serve, but not file, its motion for summary judgment on or before August 3, 2026. Plaintiff shall serve, but not file, any opposition on or before September 3, 2026. Defendant shall serve, but not file, any reply on or before October 5, 2026. The parties shall thereafter coordinate filing their respective submissions on the docket.
