ORDER DENYING MOTION TO STAY JUDGMENT PENDING APPEAL (Doc. # 94 ). Plaintiff has filed a pro se motion to stay the Court's judgment pending appeal. In determining whether to issue a stay, courts consider four factors: (1) whether the stay applicant has made a strong showing that he is likely to succeed on the merits; (2) whether the applicant will be irreparably injured absent a stay; (3) whether issuance of the stay will substantially injure the other parties interested in the proceeding; and (4) where the public interest lies. SEC v. Citigroup Global Markets Inc., 673 F.3d 158, 162 (2d Cir. 2012) (per curiam). Plaintiff's motion does not address any of these factors. Instead, plaintiff complains about its attorney. Moreover, the motion to stay has not been filed in the name of an attorney but in the apparent name of an individual (signed in the name of Salissoa Karim-Seiden). Because the plaintiff is a limited liability company, only an attorney may represent a company in federal court proceedings. See Lattanzio v. COMTA, 481 F.3d 137, 139-40 (2d Cir. 2007). If plaintiff wishes to pursue further relief before this Court, it must do so by means of a filing by an attorney. It is so ordered. Signed by Judge Jeffrey A. Meyer on 8/9/2023. (Lewis, D)
