ORDER: The 82 Motion for Extension of Time to Complete Discovery is granted. The proposed discovery plan filed at [82-1] is so-ordered with revisions. The deadline to join new parties or amend pleadings is extended to October 15, 2026. The deadline for the parties to file a joint status report certifying the close of discovery, and indicating whether Phase II Discovery should remain stayed until after any summary judgment motion is decided, is extended to November 6, 2026. The deadline to request a pre-motion conference in advance of any dispositive motion is extended to December 7, 2026. The deadline for the parties to file a joint Proposed Pretrial Order is extended to January 7, 2027.
The Settlement Conference previously scheduled for July 31, 2026 is adjourned to November 9, 2026 at 2:00 p.m. in Courtroom 11C South before Magistrate Judge Peggy Kuo. Plaintiffs must be present. A representative of Defendants with complete settlement authority (other than counsel) must be available to participate by phone.
The parties are directed to submit their confidential ex parte settlement statement to Kuo_Chambers@nyed.uscourts.gov by November 1, 2026. The statements must include the last offer and demand, and a frank assessment of the strengths and weaknesses of each party's case. For guidance on the requirements for the statements, the parties should consult Magistrate Judge Peggy Kuo's Individual Practice Rules.
