Having reviewed the parties joint petition, ECF 72, the Court hereby GRANTS the motion to seal, ECF 67, that was previously conditionally granted, see ECF 68. The parties have filed a sealed joint petition for approval of a settlement pursuant to M.G.L. c. 231, § 140C. The statute provides, in pertinent part, that the court may review and approve a settlement for damages because of personal injury to a minor... in any case before the court where any party has filed a petition for settlement approval signed by all parties. M.G.L. c. 231, §140C. This statute is specifically designed for the circumstance where the plaintiff is a minor and thus represented by a guardian, usually the parents. Abdulky v. Lubin & Meyer, P.C., 102 Mass. App. Ct. 441, 446, review denied, 492 Mass. 1103 (2023). Its primary purpose... is to ensure that the settlement is fair to the childincluding, significantly, whether the parents have acted in the childs best interests. Id. at 447.
After careful review of the petition, the Court concludes that the proposed settlement is fair, reasonable, and in the best interests of the minor child. The Court is satisfied that the structured settlement proceeds are for the sole benefit of, and will belong exclusively to, the minor, rather than his mother or any other person. Accordingly, the parties joint petition 72 is GRANTED. (SEALED Approved Joint Petition attached) (Currie, Haley).
